Miami Twp. man who shoots roommate over a cigarette pleads guilty

A Miami Twp. man accused of shooting his roommate in the mouth in February after he would not give him a cigarette faces up to 12 years in prison.

Damarion Charles Lee, 25, pleaded guilty Thursday before Montgomery County Common Pleas Judge Steven Dankof to felonious assault. A second felonious assault charge was dismissed as part of his plea.

Lee is scheduled to be sentenced Jan. 8.

Miami Twp. police responded to a shooting reported Feb. 19 inside a residence in the 6300 block of Saxony Road.

Lee was walking outside in the snowy yard when police arrived. He approached the officers with his hands in the air and was detained, according to an affidavit filed in Miamisburg Municipal Court.

Inside, officers found Lee’s roommate with a gunshot to the mouth, the document stated.

The pair were in the living room when Lee asked his roommate for a cigarette. The roommate told police he would not give Lee a cigarette and that he then went to his separate bedroom to lay down. Seconds later, the roommate said, Lee shot him, the affidavit read.

The roommate was taken to a local hospital.

Lee is held on XXXX bail in the Montgomery County Jail.
